Cancellation Policy

1. SITE SURVEY & CONFIRMATION A completed Site Survey and Breakfast Ball approval are required before booking. The date is reserved after this Agreement is signed and the 25% deposit is paid. 2. PAYMENT A 25% deposit is due at booking; the balance is due 3 days before the event. Approved extras or damage charges may be billed separately. 3. CANCELLATION, WEATHER & SAFETY Cancellations 7+ days before the event receive a refund. Within 6 days, the deposit is retained and other payments refunded. Breakfast Ball may delay, modify, suspend, or stop operation for unsafe weather, site conditions, conduct, or other risks. If service ends before half the contracted time, an adjustment up to 50% may be provided; after halfway, no refund is due. If Breakfast Ball cancels before mobilization for unsafe conditions, payments will be refunded or credited. 4. BREAKFAST BALL RESPONSIBILITIES Breakfast Ball provides delivery, setup, included equipment/staffing, operation, teardown, removal, and cleanup. Setup/teardown are separate from operating time. 5. CUSTOMER / VENUE RESPONSIBILITIES Customer must provide accurate site information, timely access, an approved setup area, suitable power, required permissions/permits, and disclose venue/access restrictions. Customer is responsible for guest/minor supervision and maintaining a safe area. 6. TRAVEL From Sissonville, WV: up to 25 miles included; 26–50 miles $50; 51–100 miles $100; over 100 miles requires a quote. 7. EVENT TIME & OVERTIME Contracted time is simulator operating time. Additional time is subject to availability and the agreed rate. 8. EQUIPMENT, CONDUCT & DAMAGE Breakfast Ball controls its equipment and may stop unsafe/disruptive participation. Guests must follow operator instructions. Customer may be responsible, as allowed by law, for damage caused by intentional, reckless, or clearly improper use. 9. TECHNOLOGY / OUTSIDE CONDITIONS Breakfast Ball will reasonably address technology interruptions but cannot guarantee uninterrupted service when affected by venue utilities, third-party systems, weather, closures, or circumstances beyond its control. 10. GENERAL TERMS This Agreement, approved Site Survey, and written Event Order/addenda form the event agreement. Changes require mutual agreement. West Virginia law applies. Electronic signatures are accepted. If one provision is unenforceable, the remainder stays effective. Participant waivers are separate
